Below are the general criminal punishment ranges.
Misdemeanor Criminal Offense | |
Class A | Punishable by up to one year in the county jail and/or up to a $4,000 fine |
Class B | Punishable by up to 180 days in the county jail and/or up to a $2,000 fine |
Class C | Punishable by a fine up to $500 |
Felony Criminal Offense | |
Capital | Punishable by death OR life in prison without parole OR life in prison |
1st Degree | Punishable by not less than five and not more than 99 years, OR life, in prison and optional fine up to a $10,000 |
2nd Degree | Punishable by not less than two and not more than twenty years in prison and optional fine up to a $10,000 |
3rd Degree | Punishable by not less than two and not more than ten years in prison and optional fine up to a $10,000 |
State Jail | Punishable by not less than 180 days and not more than two years in a state jail and optional fine up to a $10,000 |
The above are the standard punishment ranges for misdemeanor and felony offenses and do not address enhanced punishment because of prior convictions and repeat offender for specified criminal offenses, habitual offender and repeat offender status.
